Moving a Tenancy

If you have a tenant that wishes to switch rooms, you have the option to 'Change room' on COHO. Before moving the tenancy from one room to another, it is important to understand the consequences:






WARNING
  1. Legally there is no connection at all between one tenancy and the next tenancy. You cannot transfer anything at all. This is true whether they are moving room in the same house or moving to another house.
  2. You need to do all your compliance work again, including but not limited to:
  3. Re-registering the deposit certificate and that entire process
  4. Re-serving the How To Rent Guide and all compliance docuemnts (EICR/Gas Safety etc...)
  5. Carrying out a new Right to Rent check (you could have someone who is legally in a tenancy but not legally able to enter into a new tenancy)
  6. Referencing if you have an insurance policy on their tenancy. The previous references may not be acceptable by the insurance company anymore.
  7. A copy of their new inventory and getting it signed
  8. The rent book/rent schedule between one tenancy and a follow up tenancy have nothing to do with each other
  9. If there are arrears on the previous tenancy then these arrears won't count for the new tenancy and you cannot rely on them for a section 8 eviction
  10. Deposit deductions for the old tenancy cannot be charged on the new tenancy
  11. This means you should use this opportunity to charge deductions for the check-out on their current tenancy
  12. In fact, our strong recommendation is to ask the tenant to pay a new deposit for the new room and to handle the refund of their old deposit completely separately
